1. Agreement to Terms

By accessing or using Agentic Academy ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

The Service provides online training courses for agentic development tools including Claude Code, Codex CLI, Gemini CLI, Copilot CLI, Cursor AI, and Agentic AI in Finance. The Service includes interactive training modules, assessments, downloadable reference cheat sheets, and certificates of completion upon successfully passing the assessment.

Important: Certificates issued by Agentic Academy are certificates of completion only. They are not official certifications and are not endorsed by or affiliated with Anthropic, OpenAI, Google, Microsoft, or any other tool provider. These certificates demonstrate that you have completed our training program and are intended for personal and professional reference purposes only.

3. Account Registration

To access the Service, you must:

Provide accurate and complete registration information
Maintain the security of your account credentials
Have the legal capacity to enter into contracts (in Switzerland, this generally requires capacity of judgment; if you are under 18, please ensure you have appropriate parental or guardian consent)
Accept these Terms of Service and our Privacy Policy

You are responsible for all activities that occur under your account.

3a. Kids Academy & Parental Consent

Kids Academy is designed for children ages 8-16 learning with parental involvement.

Parental Consent Required: By registering a child for Kids Academy, the parent or guardian represents that they have the authority to consent on behalf of the child and agree to these Terms on the child's behalf
Co-Learning Design: Kids Academy content is designed for parents and children to learn together. Parents are encouraged to participate in lessons and activities
Age-Appropriate Content: All Kids Academy content is reviewed to be appropriate for the designated age groups (Explorer 8-11, Builder 12-14, Creator 15-16)
Account Responsibility: Parents/guardians are responsible for supervising their child's use of the Service and ensuring appropriate use
US Users (COPPA): For children under 13 in the United States, we require verifiable parental consent before collecting personal information

Kids Academy includes gamification features (XP, levels, badges) to enhance engagement. These are designed to encourage learning, not to promote excessive screen time.

4. Pricing and Payment

The Service offers the following purchase options:

Single Track: $20 USD (one-time payment for access to one training track - Pro or Kids)
Complete Bundle: $30 USD (one-time payment for access to all training tracks - 6 Pro tracks + 6 Kids Academy tracks)

All prices are displayed in USD. Payment is processed securely by Lemon Squeezy, our Merchant of Record, who handles VAT/tax collection where applicable. By making a purchase, you also agree to Lemon Squeezy's Terms of Service. Upon successful payment, you receive lifetime access to your purchased content.

5. No Refund Policy

All sales are final. We do not offer refunds for any purchases.

As digital content is immediately accessible upon purchase, and in accordance with Swiss law which does not mandate cooling-off periods for online purchases, we do not provide refunds under any circumstances. By completing your purchase, you acknowledge and accept this policy.

This policy does not affect your statutory rights regarding defective products under Swiss warranty law. If you experience technical issues preventing access to content you have purchased, please contact us and we will work to resolve the issue.

6. Account Sharing Prohibition

Your account is for your personal use only. Account sharing is strictly prohibited.

You may not share your login credentials with any third party. Each account is licensed for use by a single individual only. We monitor account activity to detect unauthorized sharing, including but not limited to:

Multiple simultaneous sessions from different locations
Unusual patterns of IP address usage
Access from an excessive number of unique devices

Enforcement: Accounts flagged for suspected sharing will be reviewed. If we determine that account sharing has occurred, we reserve the right to:

Suspend or terminate the account without refund
Revoke access to all training content and certificates
Pursue additional remedies as permitted by law

Thresholds: We use lenient detection thresholds to avoid false positives and account for legitimate use cases such as travel or VPN usage. Accounts will be flagged for manual review only if they exceed reasonable usage patterns. You will be notified in your dashboard if your account approaches these limits.

7. Intellectual Property

All content provided through the Service, including but not limited to training materials, text, graphics, code examples, and certificates, is the intellectual property of Agentic Development Training or its licensors.

Your purchase grants you a personal, non-transferable, non-exclusive license to access and use the training content for your own learning purposes. You may not:

Copy, reproduce, or distribute the training content
Create derivative works based on the content
Use the content for commercial purposes without authorization
Remove any copyright or proprietary notices

8. Certificates and Cheat Sheets

Upon successful completion of training and passing the assessment with a minimum score of 80%, you will receive a downloadable certificate of completion and access to reference cheat sheets.

Certificate Limitations: These certificates are not official certifications. They are not issued, endorsed, or recognized by Anthropic, OpenAI, Google, Microsoft, or any tool provider. They serve as proof of completing our training program only and should not be represented as official credentials.

Certificates may be shared professionally (e.g., on LinkedIn) but must not be misrepresented as official certifications. Certificates may be revoked if we determine the account was obtained or used in violation of these Terms.

9. Acceptable Use

You agree not to:

Use the Service for any illegal purpose
Attempt to gain unauthorized access to any part of the Service
Interfere with the proper functioning of the Service
Use automated systems or bots to access the Service
Submit false or misleading information
Harass or harm other users

10. Account Termination

We may suspend or terminate your account if you:

Violate these Terms of Service
Engage in account sharing
Engage in fraudulent activity
Provide false information during registration

Upon termination, your access to the Service will be revoked and no refund will be provided.

11. Educational Content Disclaimer

The content provided is for educational purposes only.

We are not responsible for:

How you apply the knowledge or skills learned through our training
Any outcomes, results, or consequences arising from your use of the learned material
Any code, projects, or work you create based on the training content
Compliance with your employer's policies or any third-party requirements
Any damages arising from the application of techniques taught in our courses

You are solely responsible for evaluating the appropriateness and applicability of the training content to your specific situation. The training is provided as general educational material and should not be construed as professional advice.

Training content reflects the state of the tools at the time of creation and may become outdated as tools are updated by their respective providers.

13. Limitation of Liability

To the maximum extent permitted by Swiss law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service.

14. Indemnification

You agree to indemnify and hold harmless Agentic Academy, its operator, and affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.
